Haran did not remind me of a special ability he has which allowed for an AoO on Latro when he moved in round 5.  At the perception check for your turn following Latro you should have stated you have the ability I can not be expected to remember all of your abilities (more so when I was unaware it was active in your current state) that AoO will not happen and no retcon.

The darkness slowly moves across the arena floor as if some sort of creeping doom were within. And then it stops suddenly.

“I grow tired of the cat and mouse. Destroy them Haran or I will leave you.”

Three bolts of pure malevolent shadow pierce the darkness. Two strike do, one with considerable success. The third bolt strikes Elemental 1.

But the darkness doesn’t stop there, immediately the shadows move toward Do’s and Elemental’s eyes attempting to cover them.

Moving across the arena, he takes a moment to buff himself a bit more before engaging with his first target. OOC:  Will continue my turn after I get some pertinent information. Do I see anybody? Also, I didn't realize what a hassle it is to update the map for two different spheres. As such. only the darkness is listed on the map. I placed "R's" on the map to indicate to center of the other effect. I didn't place the * to indicate the 30ft radius representing Spell 3. Anyone who is within 30ft and tries to move toward the R's needs to make a DC23 will save or be unable to move toward the R's. If the already failed, then no further save is necessary. THey cannot move toward the Rs. If they already passed, then no further save is necessary. They can move toward the Rs.
