Save the penalty power for later. Gromley came up with a clever and plausible way to help you, being that he is psychic. (See below.)

You are correct, they are out of play. However, Gromley pointed out that he is a telepathic-type and thought that his mental powers could be in play. I ruled that if he spent a Standard action to use his Telepathy power to make a mental link with the ghost (who is, ostensibly, "in" Nemeroff) he could then target it with mind-affecting powers. He could then use Betrayal to force it to come back "into play" condition-wise with a successful attack. He can't move it around or have it attack or the like since he's essentially changing its condition (from out of play to in-play), but he does daze it.
So, basically, house ruling because Gromley is an Epic-level psion and because his basic premise made sense to me.
